AWS Auction To Proceed As Planned

The Third Circuit Court of Appeals has turned down a request to stay the FCC's 3G auction. A few small companies had filed suit because of recent changes to the designated entity rules that would prevent small companies from bidding on spectrum for large carriers. The small carriers that were protesting claimed that the new rules would make it difficult for them to get financing to participate in the auction and that they no longer helped the small companies they were designed to protect. The court found these claims were not enough to stay the auction since a majority of bidders in the AWS auction qualified as designated entities and the large majority of those companies had not complained. The auction will begin on August 9 with new rules regarding blind bidding and designated entities in place. There is still a chance the court could revisit the new designated entity rules at a later date.
