California Now Requires Warrants for Cell Phone Searches

California recently reversed an earlier ruling and moving forward will now require law enforcement officials to obtain a search warrant before they can search the contents of an arrestee's cell phone. Law enforcement must show probable cause that such a search is warranted. The law also applies to other portable electronics, such as tablets, laptops, computers, and cameras. Before this reversal, California had "legalized the warrantless search of cell phones during an arrest, regardless of whether the information on the phone is relevant to the arrest or if criminal charges are ever filed." The reversal was approved unanimously by the California State Assembly and goes into effect this week.
