Non AT&T Android phones w/Data Unlimited?

So my wife & I are needing new smartphones soon. I don't need data; my wife has the Data UNL right now, uses it sporadically on her 5230, and we're kinda needing phones that can sync with calendars iCal (but we can sync that with Google Calendar with an Android). Being required to have a non-unlimited data plan (a minimum increase of $25) isn't an option, so we'll be going unlocked, unbranded phones* - either Symbian or Android. What I'm needing to know is whether non-AT&T Androids will be flagged as smartphones. I'm pretty confident that Symbian phones (probably an N8 or 700 for me) won't have the data plan auto-added, since I've had multiple Symbians previously on pay per use. However - what about Android phones that are not currently...

Its by imei, I don't believe there are any android phones that will pass the checks. Symbian phones may help you sneak through. If you are not interested in the b.s. that comes with att postpaid plans you may want to consider straight talk, they use att's network 😉

Actually that is not true. We have TWO International devices (GT700 I9100)with both IMEIS registered on ATT which show up as Dumbphones on MediNet UL data plans.

We have Been using International androids since the Vibrant, then the SGS II i9100, and now the GT-7000 Note

all on unlimited MediaNet. ATT has the actual IMEI numbers but they don;t have every phone made in their registration system so it shows up as unknown and they offer the MediaNet plan.

I refuse to pay $600+ a year for "carrier data" We use at most 800mb BETWEEN both phnones, We are on wifif 90% of the time. As long as ATT has this "loophole" we will use it. I have saved well over $1000 even after the purchase of used International phones and selling new ATT subsidized devices. If ATT changes their plan, we won't use the subsidy program and stick with what we have or move to a pay as you go service with the international device...

Buy International devices. ATT does not have every IMEI of every phone in the world in their data base/ I use and International Note and the wife and International SGS II BOTH IMEIS were given to ATT. Both devices show up as clam shell phones. Both devices have UL MediaNet data bit are NOT REQUIRED to have ANY data,,

That is the best solution. Plus the International devices are not ful of carrier bloat and get updates a lot soonner as they don;t have to go through ATT's processes for each update. In our case we use custom ROMS which get updates even sooner than Samsung releases. We are on 4.04 and JB is already in preview mode on some phones.
