Instinct Mobile Sync, Ect
I've been using the Instinct since it was released and it has seemed to slow down alot. It hangs up sometimes and texts randomly fail even when I have "full bars". Also mobile sync is not working on my phone and they told me an update is being released. Why does a new phone already need an update?

Well, first off, updates are required most for new electronics. That's when customers first get their hands on a new electronics, and begin to experience problems. That's when they give Sprint feedback on what's up with the phone, and with the next update, majority of minor problems will be fixed.
Updates are a normal thing, it makes the phone better than it was before.
Just because it is new, does not mean it should not have any updates.

My point was why doesn't sprint do enough testing to find these problems before the phone is released?

Of course they do. But they don't encounter every single problem down to the bone.
Also, Sprint has a certain amount of people, who do test out the Instincts for problems before release. It's just a small group, nothing compared to the people who have purchased the phone.
The people who have purchased the phone, than send out feedback on what's up with the phone. Which Sprint recognizes, and will fix.
