Motorola RAZR V3

Is this a good Deal?

I have a chance to buy a RAZR V3 from a Cingular retailer for $400. He has used it for 3 weeks and it is in perfect condition. He will sell it to me as new with a full warranty. He will also do a one year contract and throw in a car charger. Should I go for it or should I buy brand new? Amazon.com has it for $369 after rebates, but can't get the family plan through them.

My only gripe is that I cannot buy insurance for the phone. The retailer said it may be offered once the phone comes down in price.
