Supreme Court Hears Nextwave Case

The Supreme Court today is hearing arguments in the multibillion-dollar dispute over ownership of the infamous NextWave wireless spectrum. The case involves NextWave Telecom Inc., which bid on frequency bands but then filed for bankruptcy protection before paying for them. The FCC reclaimed the spectrum and then resold it. NextWave claims that the spectrum was protected by bankruptcy law, and the FCC had no right to reclaim it. An appeals court sided with NextWave. The FCC claims that NextWave has also failed to provide services using the spectrum, violating the terms of the license. The ruling is not expected for several months.
