This way the people who most need fast data will be the very ones least able to use it. Tiered pricing would be better than this. Although I suppose it's better than an overage. But on an "unlimited" plan it kinda sucks.

The original plan was never unlimited - it had a 5GB cap, at which point you incurred overage charges of $0.20/mb. Personally, I feel throttling the account is a much, much better option.

Of course you may be throttled after 5GB, but it depends on your usage scheme. If you always go over 2x, then you're likely get slowed down, but if you go over momentary (like once every few months), you should be OK.
However, my suggestion is 10GB, but $40 with qualified calling plan, this not bad at all; moreover, if you bring in your device (Option iCON 452) or buy USB stick in full price, you won't be bound by contract.
